These Terms of Use govern access to and use of the audit-ia platform. By creating an account or using our services, you agree to be bound by these terms.

Purpose

audit-ia is a SaaS platform that provides AI-powered compliance audits and cryptographically signed consent proof storage for commercial consent management (email, SMS, telemarketing) in accordance with GDPR requirements.

Definitions

"Platform" — The audit-ia website and associated services accessible at audit-ia.com
"User" — Any natural or legal person who creates an account on the Platform
"Service" — All features provided by the Platform, including compliance audits, consent proof storage, URL monitoring, and reporting
"Content" — Any data, documents, or information uploaded or generated through the Platform

Access and Registration

Access to the Service requires creating an account with a valid email address. You must provide accurate and complete information during registration.

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. If acting on behalf of an organization, you must have the authority to bind that organization.

You are responsible for maintaining the confidentiality of your login credentials. Any activity under your account is your responsibility. You must notify us immediately of any unauthorized access.

We strongly recommend enabling two-factor authentication (2FA) for enhanced account security.

Service Description

The Platform provides the following services depending on your subscription tier:

AI-powered compliance audits of web pages and consent forms
Cryptographically signed consent proof storage and verification
Automated URL monitoring for compliance changes
Compliance reporting and dashboards
RESTful API for consent proof management integration

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance.

User Obligations

As a User, you agree to:

Use the Platform only for lawful purposes and in compliance with these Terms
Provide accurate and up-to-date information
Not attempt to circumvent security measures, reverse engineer the Platform, or use automated tools to access the Service outside the provided API
Not resell, sublicense, or redistribute the Service without written authorization
Respect the usage limits of your subscription tier
Ensure you have the right to upload any content to the Platform

Subscriptions and Payment

The Platform offers multiple subscription tiers (Free, Professional, Enterprise) with different features and usage limits.

Paid subscriptions are billed monthly or annually through our payment processor (Stripe). Prices are displayed in the applicable currency excluding taxes unless stated otherwise.

Subscriptions automatically renew unless cancelled before the renewal date.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

Refunds are handled on a case-by-case basis. Contact us at contact@audit-ia.com for refund requests.

Intellectual Property

The Platform, its design, software, algorithms, and documentation are the exclusive intellectual property of the publisher. No license or right is granted beyond the right to use the Service under these Terms.

You retain all rights to the content you upload. By uploading content, you grant us a limited, non-exclusive license to process it as necessary to provide the Service.

Any feedback or suggestions provided may be used by us without obligation or compensation.

Limitation of Liability

The Service is provided "as is". While we strive for accuracy, compliance audit results are informational and do not constitute legal advice.

To the maximum extent permitted by law, our liability is limited to the amount paid for the Service during the 12 months preceding the event giving rise to the claim.

We are not liable for: indirect or consequential damages, data loss due to User error, third-party service outages, or decisions made based on audit results.

Personal Data Protection

We process personal data in accordance with our Privacy Policy. By using the Platform, you acknowledge and accept our data processing practices.

Termination and Suspension

You may delete your account at any time from your profile settings. Account deletion is permanent and irreversible after the grace period.

We reserve the right to suspend or terminate your account in case of: violation of these Terms, fraudulent activity, non-payment, or extended inactivity (after prior notice).

Upon termination: access to the Platform is revoked, your data is retained per our retention policy, and consent proofs are preserved for the legally required period.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, government actions, cyberattacks, internet outages, or pandemic.

Applicable Law and Jurisdiction

These Terms are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of [TO BE COMPLETED - City], France, unless mandatory consumer protection rules provide otherwise.
